Late Aretha Franklin's four sons, Clarence Franklin, Edward Franklin, Kecalf Franklin and Ted White Jr. Clarence, stand to gain equal portion of her estate after it was reported the queen of soul died without any will.

Aretha's eldest son, is incapacitated and is represented by a guardian as a niece of hers accepts the role of executor.

As in most states, under Michigan law, the sons will divide their mother's assets equally in the absence of a will, and so far no reports of conflict have emerged among family members.

It's also reported that there will be widely varying estimates as her legal representative move to downplay her wealth for tax concerns and the IRS tries to maximize the amount for its own reasons so no documents made mention of the value of Franklin's estate believed to run into the tens of millions.

Once the value is established - a process that could take years - the IRS will take any back taxes Franklin owed, then will tax her estate at 40 percent for any assets beyond $11.2 million.
